Your agreement with Frostad Studio
These Terms of Use form a binding agreement between you and Frostad Studio, a Washington State business and the operator of Bloom Log. They apply to Bloom Log's websites, browser-based application, subscriptions, and related services (collectively, “Bloom”). By selecting an acceptance control after these terms are presented to you, you agree to these terms and acknowledge that you have read our Privacy Policy. If you do not agree, do not use Bloom.
Eligibility and accounts
Adults only
You must be at least 18 years old and legally able to enter into this agreement. Bloom is not directed to children or minors.
Bloom is offered only to people located in the United States. You may not create an account or use Bloom from outside the United States.
Your account
You must provide an email address you are authorized to use and keep your account information current. Bloom uses one-time codes sent by email. You are responsible for securing your email account, browser, device, and any active Bloom session, and for activity under your Bloom account unless it results from Frostad Studio's failure to use reasonable security measures.
Tell us promptly at hello@bloom-log.app if you believe your account or sign-in link has been accessed without permission.
Personal reflection, not medical care
Bloom is a personal logging and reflection tool. It is not a medical device, healthcare provider, diagnostic service, treatment, or substitute for advice from a qualified professional. Bloom does not interpret your records as medical conclusions, establish a clinician-patient relationship, or promise that any pattern is accurate or meaningful.
Heart-rate readings and other information can be delayed, incomplete, inaccurate, or unavailable because of device fit, sensor quality, movement, firmware, Bluetooth, browser behavior, or other factors. Do not use Bloom to diagnose or monitor a condition, make treatment decisions, or decide whether to seek care.
Bloom is not an emergency service and is not monitored for emergencies. If you may be experiencing a medical emergency, call 911 in the United States or your local emergency number. Do not wait for Bloom, a device reading, or a response from Frostad Studio.
Encryption, trusted devices, and backups
Your records and encrypted backup
Your browser stores readable local copies of your sessions, heart-rate samples, ratings, moods, physical states, desire arc, physical comfort, session intentions, whether a session met the need, partner context, and related history. For signed-in users, Bloom encrypts each session in the browser and attempts to back it up to Frostad Studio's service when the app can connect. A backup may be delayed or fail, so check the backup status shown in Bloom and keep an export if you need a separate copy. You retain ownership of your records and remain responsible for what you choose to record and for exported files you save or share.
Bloom uses last-write-wins synchronization. If devices change the same session, the change with the later modification time is kept; a device identifier breaks an exact timestamp tie. Network delays, device clocks, browser limits, corruption, or software errors can cause delayed sync, conflicts, or loss. We do not guarantee that every record can always be preserved or restored.
Recovery is your responsibility
Bloom gives you a recovery code when encrypted backup is first set up. Frostad Studio does not receive or store the plaintext recovery code or master encryption key. You can add a trusted device by securely transferring encrypted access from a device you already use. Keep the recovery code secure and maintain access to at least one trusted device. If you lose every trusted device and the recovery code, existing encrypted history cannot be recovered by you or Frostad Studio.
A trusted device can replace your recovery code; after replacement completes, the previous code no longer works. Once removal succeeds, Bloom's service rejects that browser's device credential for later encrypted-backup access and trusted-device approvals. While Bloom is open, it checks the browser's authorization when the browser comes online, when the Bloom window regains focus, and periodically while the browser remains signed in. If validation reports that the browser is no longer authorized, Bloom signs it out and attempts to delete that account's locally stored Bloom records, device credential, and wrapped backup key. If validation is inconclusive—for example, because Bloom cannot reach the service—Bloom does not begin this cleanup based on that attempt alone. Data may remain on an offline browser, or when browser storage prevents cleanup, until Bloom is opened online and cleanup completes. Exported files and other copies outside Bloom are not affected.
Encryption and trusted-device controls do not protect records that are already open on a compromised trusted browser, or protect against malware or malicious code delivered to that browser. No browser-based transfer or storage system can be guaranteed completely secure.
You may export a readable copy. When we complete a verified account-deletion request, we remove Bloom's encrypted backups and associated account records, but cannot remove exported files or copies you shared. Other online devices lose access and remove Bloom data when deletion is detected; offline devices cannot be remotely erased until they reconnect or their Bloom site data is cleared. Signing out on one device removes Bloom data only from that browser and does not delete the account or encrypted backup.
Device and browser compatibility
Bluetooth and heart-rate capture depend on compatible third-party hardware, firmware, operating systems, browsers, permissions, radio conditions, and manufacturer behavior. Compatibility descriptions reflect the information and testing available to us, not a guarantee that every device or future version will connect or remain supported. Devices may require a broadcast, workout, or similar mode. Heart-rate capture is optional, and you can use Bloom without connecting a device.
Subscriptions, billing, and cancellation
Paid access
Some Bloom features may require a paid subscription. The price, billing interval, trial or promotional terms, taxes, and other purchase details shown at checkout become part of these terms. Stripe processes payments and manages billing. You authorize Stripe and Frostad Studio to charge the payment method you provide for the amounts disclosed at checkout.
Automatic renewal
Unless checkout says otherwise, a paid subscription renews automatically at the disclosed interval until canceled. Before you subscribe, checkout will show the recurring price and how to cancel. We may change future subscription prices by giving advance notice required by applicable law. A price change will not take effect before the date stated in that notice.
Trials and promotions
If Bloom offers a trial or promotion, its duration, eligibility, conversion, and billing terms will be disclosed when you enroll. Unless those terms say otherwise, a trial that requires a payment method becomes a paid, automatically renewing subscription at the displayed price when the trial ends unless you cancel beforehand. We may limit eligibility for trials or promotions to prevent misuse.
Cancellation and refunds
You can cancel through the subscription-management control in Bloom or the linked Stripe customer portal. Unless checkout or applicable law says otherwise, cancellation stops renewal and paid access continues through the end of the current paid period. Cancellation does not delete your account or its encrypted backup; signed-in encrypted backup remains available as part of Bloom's free functionality.
If you delete your account while subscribed, Bloom immediately deletes the Bloom account and encrypted backup after successful confirmation and tells Stripe not to renew the subscription. The Stripe subscription may remain scheduled through the end of the paid period for billing administration, but it does not keep the Bloom account or encrypted history active. Bloom access ends immediately, and the unused portion of the paid period is not refunded unless required by law. Stripe and Frostad Studio may retain limited transaction, invoice, subscription, and payment records when reasonably necessary for billing, tax, accounting, dispute, fraud-prevention, or other legal purposes.
Charges are generally final and nonrefundable once a billing period begins, except where applicable law requires a refund or the purchase terms expressly provide one. Frostad Studio may issue a refund or credit at its discretion, but doing so once does not promise future refunds. Contact hello@bloom-log.app promptly if you believe a charge is incorrect.
If a payment fails or becomes overdue, we may retry the charge, ask you to update the payment method, or suspend paid access. You remain responsible for amounts properly incurred before cancellation.
Use Bloom responsibly
You may use Bloom only for lawful, personal purposes and in accordance with these terms. You may not:
- use Bloom in a way that violates another person's privacy, intellectual-property rights, or other rights;
- record, submit, or share information about another person without any permission required by law;
- use Bloom to exploit, harm, threaten, harass, stalk, or facilitate illegal conduct;
- attempt to gain unauthorized access to Bloom, another account, or connected systems;
- interfere with Bloom's security, integrity, availability, or normal operation;
- introduce malware, abuse automated requests, scrape protected portions of Bloom, or evade access or usage limits; or
- copy, resell, sublicense, reverse engineer, or create derivative works from Bloom except as applicable law expressly permits despite this restriction.
You are responsible for ensuring that your use of a connected device and any records involving another person comply with applicable law and respect that person's rights.
Ownership and license
Frostad Studio and its licensors own Bloom, including its software, interface, branding, text, graphics, and other content, excluding records you create and third-party materials. Subject to these terms, Frostad Studio grants you a limited, personal, revocable, nonexclusive, nontransferable license to access and use Bloom for its intended purpose.
If you voluntarily send Frostad Studio a diagnostic file, backup, screenshot, or other support material, you give us a limited permission to access, copy, and use it only as reasonably necessary to investigate your request, protect Bloom, or comply with law. Our handling of that material is described in the Privacy Policy.
If you send suggestions or feedback, you allow Frostad Studio to use them without restriction or compensation, but you are not required to provide feedback and this permission does not transfer ownership of your personal records.
Third parties, changes, and termination
Third-party services
Bloom uses Stripe for payment processing and billing and relies on cloud, hosting, authentication, email, and other service providers to operate. These services may be governed by separate terms and privacy policies. Frostad Studio does not control and is not responsible for third-party services, outages, changes, or acts, but this does not limit any responsibility we cannot lawfully exclude.
Changes to Bloom
We may add, change, suspend, or discontinue features to maintain, secure, improve, or evolve Bloom. We will use reasonable care when changing local-data or encrypted-backup formats and give notice when a change materially affects paid access or when law requires notice. We do not guarantee that any particular feature, integration, backup service, or compatible device will remain available indefinitely.
Suspension and termination
You may stop using Bloom at any time or request account deletion by contacting us from the email address associated with your account. We may restrict, suspend, or terminate access if we reasonably believe you materially violated these terms, created a security or legal risk, failed to pay, or used Bloom in a way that could harm another person or the service. When practical, we will give notice and an opportunity to correct the issue. We may act immediately where reasonably necessary for security, safety, fraud prevention, legal compliance, or protection of others.
Provisions that by their nature should continue after termination will survive, including ownership, payment obligations already incurred, disclaimers, limits of liability, dispute terms, and general provisions.
Disclaimers and limits
No warranties
To the fullest extent permitted by law, Bloom is provided “as is” and “as available.” Frostad Studio disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant that Bloom will be uninterrupted, error-free, completely secure, compatible with every device, or able to preserve, synchronize, decrypt, or recover every record. Nothing in these terms excludes a warranty or consumer right that applicable law does not allow us to exclude.
Limit of liability
To the fullest extent permitted by law, Frostad Studio and its owners, personnel, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, records, or business opportunities, arising from or related to Bloom—even if advised that such loss was possible.
To the fullest extent permitted by law, the total liability of Frostad Studio and those parties for all claims arising from or related to Bloom will not exceed the greater of $100 or the amount you paid Frostad Studio for Bloom during the 12 months before the event giving rise to the claim.
These exclusions and limits do not apply to liability that cannot lawfully be excluded or limited, which may include liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or violation of nonwaivable consumer rights, depending on applicable law. If your jurisdiction does not allow a particular exclusion or limit, it applies only to the maximum extent permitted there.
Your responsibility for misuse
To the extent permitted by law, you will indemnify and hold harmless Frostad Studio and its owners, personnel, and contractors from third-party claims, losses, and reasonable costs resulting from your unlawful use of Bloom, your material violation of these terms, or your infringement of another person's rights. This obligation does not apply to the extent a claim results from Frostad Studio's own negligence, willful misconduct, or violation of law. We will notify you of a covered claim and allow you to participate in its defense; you may not settle it in a way that admits fault by or imposes obligations on Frostad Studio without our written consent.
Disputes and general terms
Resolving concerns
Before filing a formal claim, you and Frostad Studio agree to try in good faith to resolve the concern by written notice and 30 days of informal discussion. Send your notice to hello@bloom-log.app and describe the issue and requested resolution. Either party may still seek urgent injunctive relief when reasonably necessary, and this paragraph does not prevent a claim in small-claims court or shorten any legal filing deadline.
Governing law and courts
These terms are governed by applicable federal law and the laws of the State of Washington, without regard to conflict-of-law rules. Unless applicable consumer law gives you the right to bring a proceeding elsewhere, you and Frostad Studio agree that any court proceeding must be brought in a state or federal court of competent jurisdiction in Washington State. These terms do not take away mandatory protections or remedies available to you under the law where you live.
Changes to these terms
We may update these terms as Bloom changes. We will revise the effective date and provide additional notice before a material change takes effect. Changes apply prospectively. We will ask you to affirmatively accept a material change before the revised terms govern your continued use. If you do not agree, you must stop using Bloom and may cancel your subscription.
Other legal terms
If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining terms will continue. A failure to enforce a provision is not a waiver. You may not assign this agreement without Frostad Studio's written consent. Frostad Studio may assign it as part of a merger, acquisition, reorganization, or transfer of the relevant business or assets, provided the assignment does not reduce any nonwaivable consumer rights.
These terms and any purchase terms presented at checkout are the entire agreement between you and Frostad Studio about Bloom and replace earlier discussions about the same subject. The Privacy Policy describes how Frostad Studio handles information; it is not part of this contract. If purchase terms conflict with these terms, the purchase terms control only for that purchase. Section headings are for convenience and do not affect interpretation.
